Terms & Conditions of sale

These terms and conditions apply to JR Customs PCs website and all transactions

1. Definitions

Buyer - The customer, who purchases the goods from the seller and to whom the goods are invoiced 

Seller - JRs Custom PCs 

Terms and Conditions -   

This document that outlines the contract between the seller and the buyer, and to which you must agree to, at time of sale.

Contract - The binding sales agreement, between the buyer and seller and to which these terms and conditions apply.

Goods - The bespoke product, that the buyer agrees to purchase, based on the agreed specification in the quote and order confirmation. 

Price - The price provided at quotation, order confirmation and reflected at the bottom of the invoice, which the buyer agrees to pay in full.

Order Confirmation - The document provided by the seller to the buyer detailing the products and services supplied for the given price, which includes VAT.

Quote – Document issued by the seller, to the buyer outlining the buyers’ specification requirements for the custom built goods. The quote will form part of the contract, for the order confirmation.

Affiliate - An affiliate is a person or entity that promotes another company's products or services and receives a commission for each sale or conversion resulting from their efforts. The relationship is governed by an affiliate agreement.

Goods Damaged on arrival – We take every precaution necessary, to ensure the goods are packed securely for shipping, including photos/ video at the time of packing, but in the unfortunate event, that damage is caused by the shipping company, we require the customer to immediately take photos and submit these to the seller. All goods are sent ‘Insured and Signed For‘ and the driver will be instructed, to deliver to the customer only, and not to leave goods, without a signature. 

User Damage - is any damage, accidental or intentional, caused to the internal components or external case. User damage then becomes the responsibility of the buyer
Accidental or intentional damage to Goods - Should the buyer cause damage to the goods, accidental or intentionally, all repairs will be at the cost of the buyer, this includes shipping and packaging. 

Examples, but not limited to, of Accidental or Intentional damage:

Dropping of throwing of goods

Carrying out maintenance and/or any tampering of goods and damage caused, by plugging in damaged or unsuitable goods.

Any damaged caused by liquids

Poor ventilation or over heating of fans, caused by blocked vents or fans

Electrical surge, caused by faulty external wiring. It’s the buyer’s responsibility to ensure the goods are plugged into a reliable electrical supply and directly into a local surge-protector.

2. Terms of the contract

2.1 These terms and conditions apply to all goods and services supplied by JRs Custom PCs and including, but not limited to JRs Customs PCs website. All trademarks apply. 

2.2 The contract does not apply, until an order confirmation is received from the seller 

2.3 The seller reserves the right to amend the terms given for any future sales 

2.4 The buyer has the right to cancel this contract as detailed below. Please refer to sections 6, of our terms and conditions. 

3. Descriptions, Promotions and Pricing 

3.1 All prices are final and need to be paid in full by the buyer. This will be confirmed by the seller in writing, prior to ordering of the components.

3.2 Unless goods are being collected by prior arrangement, all prices quoted will be inclusive of shipping and handling charges.

3.3 All final prices are inclusive of VAT.

3.4 At the time of order placement, if any parts or goods are unavailable, the seller will inform the buyer in writing. 

3.4.1 After further consultation, it’s the buyers choice to accept the alternative goods/prices or request a refund.

3.5 Agreed contract price is final and no discounts can be applied by the buyer. Any change requirement made by the buyer, once the order acknowledgement has been issued, may incur additional costs. 

3.6 The seller reserves the right to terminate any promotion or discount code at any time without notice. This excludes discounts/ promotions already applied to order acknowledgements

3.7 Where promotions become unavailable due to the goods being out of stock, the seller cannot be held responsible. Where possible a suitable alternative will be offered

4. Payment

4.1 Payment is to be made direct to the seller, once a final price is agreed

4.2 The customer agrees to pay 100% of the quoted price, when entering into the contract with the seller, for goods. 

5. Delivery/Collection of the goods 

5.1 "Goods" will be delivered with the sellers’ choice of courier, if the "buyer" is unable to collect 

5.2 Delivery charges are dependent on buyers location and will be agreed, as part of the order acknowledgement. 

5.3 Unless goods are being collected by prior arrangement, all prices quoted will be inclusive of shipping and handling charges.

5.4 The goods become the property of the buyer once they are signed for or collected 

5.5 Upon receipt of the goods, it’s the buyer’s responsibility to ensure the goods are in good order, nothing is missing and there is no damage to the goods or packaging.

Any damage or missing items, must be made known to the seller in writing, within 48 hours of receipt of the goods. 

6. Cancellation/Returns

6.1 Due to the bespoke nature of the goods, all sales are final and a refund for cancellation, will only be issued to the customer, on the following basis:

Up to 5 days from confirmation of order placement: 100% refund, less a £25 admin and processing fee, plus any additional costs for returning the components, if any.

Refund will be issue back to the original payment method.

After the 5 days or until the time the goods are dispatched: A 50% refund is applicable. Refund will be issue back to the original payment method.

Once the build is complete and dispatched,  No refund will be issued to the customer.

All goods returned, due to accidental or intentional damage, caused by the customer, will be at the cost of the customer.

6.2 "Goods" must be returned in the original packaging it arrived in  and insured to the full value of the goods.
 

7. Quotes

7.1 Due to high demands and component shortages, influencing market pricing, all quoted prices are valid for 48 hours, from time of issue.

7.2 Once a quote is accepted and payment has been made, the buyer has 5 working days to cancel, but will be charged for the cost of returning the components, if any. (See 6.1)

7.3 The price agreed upon between the buyer and the seller is non-negotiable after the acceptance of the quote.

8. Warranty

8.1 All goods are covered by a 28 day warranty from date of dispatch. Faulty components identified within 1 weeks of dispatch, will be investigated and if required, will be replaced by the seller.

8.2 Goods will need to be returned in the original packaging for inspection and replacement. Shipping terms to be agreed with the seller.

8.3 Faulty items identified after the initial 1 week, will be investigated by our customer support team, to determine the root cause. If the fault cannot be resolved, the seller will propose a method to resolve the issue, ensuring the customer specification is adhered to. Shipping terms to be agreed with the seller.

8.4 A full inspection will be carried out on all faulty parts, to ascertain the root cause and to eliminate user damage and/or tampering.

8.5 12 Month Parts Warranty Comes included with the price of the "Goods". However, Delivery Fees are covered by the "buyer", unless they have entered into our 3 Year Warranty Scheme which covers delivery for the 12 Month Parts Warranty.

8.6 Our 3 Year Warranty is broken down into 1 Year of Part Warranty and then 2 Years of Repairs Warranty. This means that we the "Seller" will replace any broken part within the first 12 months after purchasing. These replacements do not include "User Damage".

8.7 After the first 12 Months Part Warranty has expired then we will cover delivery costs and will perform repairs and tests on your "Goods". This service lasts for the remaining 2 Years of your Warranty. Delivery Costs will still be covered in the remaining 2 Years Repairs Warranty. Replacement of any parts of your "Goods", will come at the cost of the "Buyer".

8.8 All "Goods" must be returned in the original packaging when sent back for repairs or replacements. If the goods do not arrive in the original packaging then no repairs or replacements will be performed.

9. Affiliate Program

9.1 Program Eligibility:

Our Affiliate Program is open to businesses and Influencers that operate websites, blogs, or social media accounts that are relevant to our products and services. We reserve the right to reject any application for any reason.

9.2 Affiliate Commission:

As an affiliate, you will earn a commission on every sale made through your unique referral Code. The commission rate will be specified in your affiliate agreement. We reserve the right to change the commission rate at any time without prior notice.

9.3 Affiliate Link and Promotion:

You will receive a unique referral Code that you can share with your audience. You are responsible for promoting our products and services in a truthful and ethical manner. Any misleading or false promotion will result in the termination of your affiliate account.

9.4 Affiliate Pay out:

Affiliate pay outs are made on a monthly basis, provided that the minimum pay out threshold has been reached. The minimum pay out threshold and pay out method will be specified in your affiliate agreement.

9.5 Termination of Affiliate Account:

We reserve the right to terminate your affiliate account at any time for any reason. This includes but is not limited to violation of the terms and conditions of the Affiliate Program, engaging in fraudulent or unethical behaviour, or for any other reason at our discretion.

9.6 Limitation of Liability:

We will not be liable for any damages or losses incurred as a result of participating in our Affiliate Program. We do not guarantee any specific level of commission or sales, and we are not responsible for any technical issues or interruptions in the Affiliate Program.

9.7 Changes to Terms and Conditions:

We reserve the right to change these terms and conditions at any time without prior notice. It is your responsibility to review these terms and conditions regularly to ensure compliance. Your continued participation in the Affiliate Program constitutes acceptance of any changes made to these terms and conditions.

9.8 Promotional Guidelines:

To ensure brand consistency and compliance with our promotional guidelines, affiliates are required to use only pre-approved marketing materials and content when promoting our custom PC website. This includes product images, banners, and text copy. Any unauthorized use of our brand assets or promotional content is strictly prohibited and may result in the termination of your affiliate account and or taken legal if required. We provide our affiliates with a range of approved marketing materials and support to help them effectively promote our products while maintaining the integrity of our brand.

9.9 Discord and Servers:

Our affiliates are required to invite their viewers to our discord servers. They are not entitled to any money made from the in server purchases including: Premium Features, Access to Minecraft Servers or anything else paid for through our Patreon. Affiliates are also NOT allowed to tell viewers not to pay or use any of our services. Once any person has joined any of our servers, then we reserve the right to claim them as part of our community. The affiliate no longer has any control or input in what that person sees, does or has access to.  Anything said to our community that is not pre-approved, would mean the affiliate will face action appropriate to the severity of their actions.

10. Remote IT Work

10.1 Services:

JRs Custom PCs provides Remote IT Services, including troubleshooting, software installation, network configuration, and technical assistance.

The Services will be performed remotely, utilizing secure remote access tools, subject to the availability and functionality of the Customer's computer system and internet connection.

10.2 Service Limitations:

While JRs Custom PCs will make reasonable efforts to resolve technical issues, some problems may require on-site assistance, which may incur additional charges.

JRs Custom PCs does not guarantee the resolution of all technical issues or the prevention of future issues.

10.3 Customer Responsibilities:

The Customer agrees to provide accurate and complete information necessary for the provision of Remote IT Services.

The Customer is responsible for the security and confidentiality of their data and passwords before, during, and after the provision of Services.

The Customer must comply with all applicable laws and regulations related to the use of JRs Custom PCs' Remote IT Services.

10.4 Payment and Fees:

The fees for Remote IT Services will be communicated to the Customer prior to the provision of Services.

Payment terms, including accepted payment methods and due dates, will be outlined in the invoice provided to the Customer.

10.5 Limitation of Liability:

JRs Custom PCs will make reasonable efforts to provide effective Remote IT Services, but does not guarantee the resolution of all technical issues or the prevention of future issues.

JRs Custom PCs shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the provision of Remote IT Services.

10.6 Confidentiality:

JRs Custom PCs agrees to treat all information provided by the Customer as confidential and will not disclose it to third parties, except as required by law or with the Customer's consent.

Remote sessions are recorded and logged so that the User can feel safe knowing that if anything goes wrong, we have it on video.

10.7 Termination:

Either party may terminate the provision of Remote IT Services by providing written notice to the other party.

Upon termination, any outstanding fees shall be paid by the Customer.

11. Terms of sale 

11.1 These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the terms and conditions.
